Privacy Policy

Notice to clients of Dian Holding Limited ("Dian") relating to the Personal Data (Privacy) Ordinance (the “Ordinance”):

(A) The data relating to a client may be used for the following purposes:
  1. Processing and/or approving loan applications, renewals and cancellations;
  2. Daily operations of the services and credit facilities;
  3. Conducting credit checks;
  4. Assisting other financial institutions to conduct credit checks and collect debt;
  5. Ensure ongoing creditworthiness of clients;
  6. Designing financial services or other related products or services for our clients;
  7. Promoting financial services or other related products or services for our clients;
  8. Determining amounts owed to or by the clients;
  9. Enforcing the obligations of our clients, including and without limitation to: the collection of amounts outstanding from clients and those providing security or guarantee for our clients’ obligations;
  10. Disclosing and using data for the purposes of compliance with any laws, governmental or regulatory body, supervisory body, or court of law;
  11. Enabling an actual or proposed assignee of Dian, or participant or sub-participant of Dian to evaluate the transaction intended for assignment, participation or sub-participation; and
  12. Any purposes relating thereto.

(B) Data held by Dian relating to its clients will be kept confidential but Dian may provide and disclose such information to the following parties for the purposes set out in Paragraph A:
  1. Any agent, contractor, or third party service provider who provides administrative, telecommunications, computer, payment, debt collection, or other services to Dian in connection with the operation of its business;
  2. Any other person under a duty of confidentiality to Dian, including a member of the same group to which Dian belongs, which has undertaken to keep such information confidential;
  3. Credit reference agencies, and in the event of default, debt collection agencies;
  4. Any person to whom Dian is under an obligation or under the requirements of any law, guidelines or guidance given or issued by any court of legal, regulatory, governmental, tax, law enforcement or other authorities, or supervisory body; and
  5. Any actual or proposed assignee of Dian or participant or sub-participant of transferee of Dian’s rights with respect to the client.

(C) Under and in accordance to the Ordinance and the Code of Practice on Consumer Credit Data approved and issued under the Ordinance, any client has the right:
  1. To check whether Dian holds data about him and of access to such data;
  2. To require Dian to correct any data relating to him that is inaccurate;
  3. To ascertain Dian’s policies and practices in relation to the data and to be informed of the kind of personal data held by Dian;
  4. When related to personal credit, to be informed on request which items of data are routinely disclosed to credit reference agencies or debt collection agencies, and be provided with further information to enable the making of an access and correction request to the relevant credit reference agency or debt collection agency;
  5. In the event of any default in payment, unless the amount is fully repaid before the expiry of 60 days from the date of such default, the client is liable to have his account repayment data retained by the credit reference agency up to 5 years from the date of the final settlement of the amount in default; and
  6. Upon satisfactory extinguishment of the financing via full repayment and on the condition that there have been no default in excess of 60 days relating to the subject financing for 5 years prior to such extinguishment, to instruct Dian to make a request to the relevant credit reference agency to delete from its database any account data relating to the extinguished financing.

(E) Nothing in this notice shall limit the rights of clients under the Ordinance.


(F) In case of discrepancies between the English and Chinese versions, the English version shall prevail.
